TrailCam Terms of Use

1. The agreement

TrailCam is published by Chaojun Dou (窦朝军) ("we", "us"). By installing or using TrailCam you accept these Terms. If you do not accept them, do not use the app — and delete it, which removes everything it holds.

TrailCam is distributed through Apple's App Store, so Apple's Licensed Application End User License Agreement also applies to your copy of the app. Where these Terms and Apple's standard EULA disagree, Apple's standard EULA prevails for anything it covers. Apple is not a party to these Terms and has no obligation to provide support for TrailCam.

2. What TrailCam is

TrailCam is a GPS trip recorder. It records where you went, and lets you attach photos, video clips and voice clips to positions along that track and play them back there. It has no account and no cloud service; your trips live on your iPhone. What it is not is covered in sections 5 and 6, and those two sections matter more than any other on this page.

3. Your licence

We grant you a personal, non-transferable licence to use TrailCam on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not sell, rent or sublicense the app; you may not reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits despite this limitation.

4. TrailCam Pro — subscriptions and purchases

TrailCam is free to install, and recording, viewing and exporting a trip work without paying anything. TrailCam Pro is optional and is offered in three forms:

• a monthly auto-renewing subscription;
• an annual auto-renewing subscription;
• a lifetime unlock, which is a single one-time purchase and does not renew.

All three are sold and billed by Apple through your App Store account. The prices shown in the app are the ones Apple reports for your region, in your currency, and Apple may change them for new purchases.

How subscriptions renew and how to stop them. A subscription renews automatically at the end of each period unless you cancel it at least 24 hours before that period ends. Your App Store account is charged for the renewal within the 24 hours before the period ends. Cancelling is done through Apple, not through us: Settings → your name → Subscriptions on your iPhone, or the "Manage subscription" row in the app, which opens the same place. Deleting the app does not cancel a subscription. Cancelling stops future renewals; the current paid period runs to its end.

Refunds and free trials. Refunds are handled by Apple under Apple's refund policy — we cannot issue one. If an introductory offer or free trial is available and you buy a subscription during it, the unused part of the free period is forfeited, as Apple's rules require.

Restoring. A purchase is tied to your Apple Account, so you can restore it on another device you own from the paywall's restore action.

We may change what Pro includes in a future version. If a feature you paid for is removed from Pro, that will be stated in the app.

6. Accuracy — what the numbers are worth

Satellite positioning is an estimate, and every figure TrailCam shows is derived from it. Buildings, tree cover, canyons, tunnels, cliffs and weather all degrade it, sometimes badly. Distance, elevation, climb, pace and the shape of the drawn line are therefore approximations. The place name and weather shown on a trip card come from third-party services looked up once at the trip's starting point, and can be wrong or stale.

Do not use TrailCam's output where an accurate measurement matters: surveying, insurance, legal boundaries, competition results, navigation in terrain you do not know, or anything else where a wrong number has consequences.

7. Your content stays yours

Your trips, photos, videos and voice clips belong to you. We claim no licence over them and we have no technical means to reach them: they are on your device, and this version has no server that receives them. Export them whenever you like, as GPX or CSV.

Backups are your responsibility. Because your data lives only on your device, deleting the app, erasing the device, or losing the device without a backup loses your trips. We cannot recover them for you — not as a policy, but as a fact of the design. Keep a device backup, and export anything you would be unhappy to lose.

8. Recording other people

TrailCam can take photos, record video and record audio. Whether you may do that, in the place you are, of the people or property in frame, is governed by local law — and in many jurisdictions recording audio of a conversation requires the consent of the people in it. That is your responsibility, not ours. Do not use TrailCam to record, follow or track any person without their knowledge and consent.

9. No warranty

TrailCam is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that recording will never be interrupted, that the app will be free of defects, or that any particular trip will be captured completely. iOS may terminate any app, a device may run out of battery or storage, and hardware fails.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, for lost or corrupted data, or for any injury, loss or damage arising from your use of — or reliance on — TrailCam or anything it displays. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Where liability can be limited but not excluded, it is limited to the amount you paid for the app in the twelve months before the claim arose.

11. Changes and termination

We may update the app and these Terms. A material change to the Terms will be reflected in the effective date at the top of this page and, where it affects how the app behaves, described in the app. You may end this agreement at any time by deleting the app; if you hold a subscription, cancel it through Apple as described in section 4, because deleting the app does not cancel it.
